8406 Initiates Campaign
To Boycott 2007 Single-party National Assembly Election
& To Demand True Pluralistic System
Dear
Fellow-Compatriots inland and overseas,
In 2007, the Communist Party of Viet Nam (CPV) and the government of
the Socialist Republic of Vietnam (SRVN) will organize a National Assembly
election that is monopolized by the CPV itself.
We, the Bloc 8406, currently consisting of 560 citizen advocates for
democracy in Viet Nam, hereby declare :
Whereas,
1.
Voting and running for positions in the National Assembly are the utmost
important duties and rights of every citizen since these acts produce
the representatives of the people at the “Institution with highest representation
of the population, with highest governmental authorities … The only
institution with the power of legislation and Constitution amending
… exercising the highest power to monitor the entire operation of the
government” (Article 83, 1992 Constitution of the SRVN). However, Article
4 of the same Constitution affirmed: “The Communist Party of Viet Nam,
the vanguard of the Vietnamese working class as well as loyal representative
of the interests of the proletarians, the laborers, and the entire nation,
under Marx-Leninism and Ho Chi Minh’s thoughts, is the force that direct
the government and society”. Clearly, Article 4 and 83 contradict each
other in the same Constitution.
2. In reality, from 1945 to 2002, for all eleven National
Assembly elections organized by the Communist Party of Viet Nam the
same practice of “Party selects, People vote” have been used, meaning
people can only vote among the candidates selected by the Party. Therefore,
once elected, these officials are not representatives of the people
but rather representatives of the Party. They become shameful subordinates
of the Party instead of honorable representatives of the people. Thus,
the National Assembly of Vietnam has always been the instruments of
the Communist Party of Viet Nam and never an independent legislative
institution with “the highest governmental authorities”.
3. Also in reality for the last 60 years, under the
Communist rule, voting has always been a forced activity on the Vietnamese
people with various methods of intimidation and coercion, including
forcing family members to vote on behalf of the absent ones. The punishment
is especially harsh on those who refuse to vote out of conscientious
objection or disgust at the fact that such noble duties and fundamental
rights have been corrupted and abused by the Communist Party of Viet
Nam to maintain and strengthen its dictatorial rule.
4. Article 4 of the Constitution and abovementioned
practices in reality have rendered meaningless and ineffective Article
6 and 7 of the Constitution, “The people shall exercise their power
of government through the National Assembly and the People Committees.
These entities represent the will and aspiration of the People; are
elected by the People and held responsible before the People…The election
of the members to the National Assembly and People Committees shall
be carried out under the principles of popular, equal, direct and confidential
voting”.
5. The practice of National Assembly elections in Vietnam
to this day has not delivered a just legal system, a genuine democracy,
or any true freedom to the country. It has not produced those representatives
who intend to carry out the will of the people; who are responsible
only to the people; and who rely only on the power, the respect and
the trust of the people to conduct their duties and to make laws. As
a result, Vietnam is still filled with dishonesty, vices, injustice,
abuse of power, corruption, backwardness, and the absence of all basic
human rights such as freedom of religion, freedom of speech, freedom
of the Press, freedom of voting and running for public offices, etc.
The nation, therefore, cannot reach the height of development in human
interests as compared to other civilized and democratic nations.
Therefore,
On
the occasion of the visit to Viet Nam on 23 May 2006 of the Secretary
General of the United Nation Kofi Annan, a relentless fighter for human
rights and peace around the world, an unwavering advocate for pluralistic
political system as the most fundamental condition for peace and stability,

We call on the Communist Party of Viet Nam, for the sake of
democracy and advancement of the country, to allow the current ceremonial
National Assembly to eliminate Article 4 of the 1992 Constitution, the
origin of all national shames and disasters.
2. We call on the government of Vietnam to hold the
2007 National Assembly election according to the principles of multi-party
competition, freedom of candidacy and freedom of voting as in other
civilized nations. This election also needs to be placed under international
observation for fairness and transparency. In order to achieve such
goals, the Government of Vietnam must issue right away the appropriate
laws and decrees so that non-communist parties and independent candidates
can participate in a fair election.
3. After the CPV's 10th Congress in April 2006, there
are no signs or even the right conditions for materializing democracy
and pluralism in Vietnam. There is no hope for a free and fair election,
no difference from last 11 National Assembly elections. Therefore, we
urgently initiate a campaign to call on our compatriots from all walks
of life, who have been restless for democracy and national advancement,
to take a courageous stand in boycotting the 2007 sham single-party
election.
Human dignity and conscience as citizens no longer allow us to participate
in such a deceitful and coerced activity. The boycott of this sham election
is the most fundamental and effective way to bring about the necessary
pressure for a free and fair multi-party National Assembly election
in Viet Nam, to end the onerous dictatorial and totalitarian yoke of
the Communist Party of Viet Nam on our nation, to open a bright future
for Vietnam among the international democratic community.
4. We call on the Party members and individuals who
will be chosen by the Communist Party of Viet Nam as candidates for
the 2007 sham election to refuse these offers on the basis of your conscience
and honor. Being elected in such manner and becoming submissive apparatus
of the Communist Party of Vietnam could only help extend the shame and
sufferings of our people which have endured in the last 60 years, and
lead the country away from any hope for a brighter future.
5. We earnestly appeal to the Vietnamese compatriots
overseas, international human rights organizations, parliaments and
governments around the world, especially the United Nation, to intervene
on behalf of the people of Vietnam with all appropriate resources to
effectively induce a free and democratic election with plural parties
as defined by international standards.
We sincerely thank all of our compatriots and people of good will around
the world.

thưa toàn thể Đồng bào Việt Nam trong và ngoài Nước,
Năm 2007
đảng Cộng sản Việt Nam và Nhà cầm quyền Cộng hòa Xã hội Chủ nghĩa
Việt Nam (CHXHCNVN) sẽ tổ chức bầu cử Quốc hội do một mình đảng Cộng
sản Việt Nam đạo diễn.
Chúng tôi, Khối 8406 hiện nay gồm 560 Công dân đấu tranh cho Dân chủ
tại Việt Nam, xét rằng :
1. Bầu cử và ứng cử
Quốc hội là nghĩa vụ và quyền lợi hết sức quan trọng của mọi Công
dân, vì nhắm chọn ra những người thay mặt cho mình tại “cơ quan đại
biểu cao nhất của Nhân dân, cơ quan quyền lực Nhà nước
cao nhất… cơ quan duy nhất có quyền lực lập hiến và
lập pháp... thực hiện quyền giám sát tối cao đối với toàn bộ hoạt
động của Nhà nước” (Điều 83, Hiến pháp năm 1992 của Nước CHXHCNVN).
Thế nhưng điều 4 Hiến pháp ấy lại xác định: “đảng Cộng sản Việt Nam,
đội tiên phong của giai cấp công nhân Việt Nam, đại biểu trung thành
quyền lợi của giai cấp công nhân, Nhân dân lao động và của cả Dân
tộc, theo chủ nghĩa Mác-Lênin và tư tưởng Hồ Chí Minh, là lực
lượng lãnh đạo Nhà nước và Xã hội”. Rõ ràng hai điều
4 và 83 nầy mâu thuẫn nhau trong cùng một Hiến pháp.
2. Trong thực tế, từ
năm 1945 đến năm 2002, 11 lần bầu cử Quốc hội do đảng Cộng sản Việt
Nam tổ chức đều áp dụng nguyên tắc “đảng cử dân bầu”, nghĩa là những
ứng viên được đưa ra cho Dân bầu đều là đảng viên hoặc đã được đảng
chọn. Vì vậy, khi đắc cử, họ không phải là những Đại biểu của Dân
(Dân biểu) mà là đại diện của đảng (đảng
biểu), chỉ làm kẻ thừa hành của đảng (thường
rất đáng hổ thẹn) thay vì làm Đại diện vinh quang của Dân. Do đó,
Quốc hội Việt Nam đã luôn là công cụ của đảng Cộng sản
Việt Nam, không phải là Tổ chức của Quyền Lập pháp độc lập và là “Cơ
quan quyền lực Nhà nước cao nhất”.
3. Cũng trong thực tế,
60 năm qua, dưới chế độ Cộng sản, việc đi bầu đã luôn
là điều bó buộc gượng ép đối với mọi người Dân Việt,
qua các hình thức đe dọa, cưỡng chế, buộc các thân nhân
bỏ phiếu thay, đặc biệt là các thủ đoạn trừng phạt rất độc đoán vô
lý đối với những ai khước từ bỏ phiếu vì lương tri và
lương tâm thấy rằng nghĩa vụ rất cao cả và quyền lợi rất cơ bản đó
đã bị đảng Cộng sản Việt Nam làm biến chất và lạm dụng
để duy trì và củng cố ách độc tài của đảng.
4. Điều 4 của Hiến pháp
và những thực tế nêu trên đã làm vô nghĩa và
vô hiệu điều 6 và điều 7 Hiến pháp: “Nhân dân sử dụng
quyền lực Nhà nước thông qua Quốc hội và Hội đồng Nhân dân là những
cơ quan đại diện cho ý chí và nguyện vọng của Nhân dân, do Nhân dân
bầu ra và chịu trách nhiệm trước Nhân dân.... Việc bầu cử đại biểu
Quốc hội và đại biểu Hội đồng Nhân dân tiến hành theo nguyên tắc phổ
thông, bình đẳng, trực tiếp và bỏ phiếu kín”.
5. Thực trạng bầu cử
Quốc hội tại Việt Nam cho tới nay đã không đem đến một
nền Pháp chế công minh, một nền Dân chủ đúng nghĩa, một nền Tự do
đích thực cho Tổ quốc, đã không tạo ra những Đại biểu
chỉ một lòng thực thi ý muốn của Dân, chỉ chịu hoàn toàn trách nhiệm
trước Dân và chỉ dựa vào sức mạnh, niềm kính trọng, lòng tin yêu của
Dân để hành xử, để tạo ra Pháp luật. Bởi thế Việt Nam vẫn đầy dẫy
dối trá, tệ nạn, bất công, cường quyền, suy đồi, tụt hậu, mất hết
các Quyền tự do rất cơ bản như Tự do Tôn giáo, Tự do Ngôn luận, Tự
do Báo chí, Tự do Ứng cử và Bầu cử,… không thể vươn tới tầm cao phát
triển Nhân sinh Nhân quyền như mọi Quốc gia Dân chủ Văn minh.
Vì
thế,
Nhân chuyến thăm Việt Nam từ ngày 23-5-2006 của Ông Tổng Thư ký Liên
Hiệp Quốc Kofi Annan, một Chiến sĩ Nhân quyền và Hoà bình rất kiên
cường của Nhân loại, luôn chủ trương Đa nguyên Đa đảng là điều kiện
cơ bản bậc nhất của Hòa bình ổn định,
1. Chúng tôi yêu cầu
đảng Cộng sản Việt Nam, vì một nền Dân chủ và Văn minh chân chính
của Tổ quốc, hãy cho phép Quốc hội bù nhìn đương quyền
xóa bỏ điều 4 của Hiến pháp năm 1992, nguồn gốc mọi quốc nhục và quốc
nạn thê thảm hiện thời của Đất nước.
2. Chúng tôi yêu cầu
Nhà nước Việt Nam phải tổ chức cuộc bầu cử Quốc hội năm 2007 theo
nguyên tắc Đa đảng, Tự do Ứng cử, Tự do Bầu cử như tại các Nước văn
minh, có Quốc tế giám sát công khai minh bạch. Muốn được thế, ngay
từ bây giờ, Nhà cầm quyền Cộng sản Việt Nam phải ban hành ngay các
Đạo luật, Pháp lệnh phù hợp để các đảng phái dân chủ phi cộng sản
và các ứng cử viên độc lập có đủ điều kiện tham gia ứng cử công bằng.
3. Sau Đại hội X của
đảng Cộng sản Việt Nam tháng 4-2006, nền Dân chủ Đa đảng
vẫn chưa có dấu hiệu và điều kiện xuất hiện, không thể hi vọng có
Tự do Bầu cử, Tự do Ứng cử thực sự, vẫn chỉ như 11 lần Bầu cử Quốc
hội trước đây. Do đó, chúng tôi khẩn cấp phát động một
cao trào kêu gọi toàn thể Đồng bào trong Nước thuộc mọi giới, mọi
ngành nghề, mọi chức vụ, mọi bậc sống đang thao thức về Dân chủ và
Văn minh cho Tổ quốc :
HÃY CAN ĐẢM TẨY CHAY CUỘC BẦU CỬ ĐỘC ĐẢNG GIẢ HIỆU 2007.
Phẩm giá con người và ý thức công dân không cho phép chúng ta tham
gia công việc gian trá và miễn cưỡng mãi như thế. Việc
tẩy chay bầu cử giả tạo ấy chính là hành vi cơ bản nhất và hữu hiệu
nhất giúp tạo áp lực cần thiết để Quê hương Việt Nam sớm có cuộc bầu
cử Quốc hội Đa đảng công bằng đích thật, chấm dứt ách
độc tài toàn trị nặng nề của đảng Cộng sản Việt Nam lên cả Dân tộc
khai mở một tương lai tươi sáng hơn cho Tổ quốc Việt Nam giữa cộng
đồng dân chủ quốc tế.
4. Chúng tôi kêu gọi
các đảng viên và những người sẽ được đảng Cộng sản Việt Nam chọn ra
ứng cử đại biểu Quốc hội Độc đảng man trá năm 2007 tới đây, hãy vì
lương tâm và danh dự khước từ việc ứng cử giả tạo đó, vì việc đắc
cử bất công đó, việc trở thành công cụ dễ bảo của đảng Cộng sản Việt
Nam đó, vốn chỉ giúp kéo dài thêm nỗi khổ nhục suốt hơn 60 năm qua
của toàn Dân chứ không mở ra chút tương lai tươi sáng nào cho Tổ quốc
cả.
5. Kính xin toàn thể
Đồng bào Hải ngoại, các Tổ chức Nhân quyền Quốc tế, các Quốc hội và
Chính phủ toàn cầu, nhất là Liên Hiệp Quốc hãy nhiệt tình làm mọi
cách phù hợp và hữu hiệu để giúp Việt Nam có được cuộc
Bầu cử Quốc hội Đa đảng, Tự do, Dân chủ theo tiêu chuẩn của thế giới
văn minh.
